Terms of Service

Effective date: July 6, 2026

These Terms of Service (these "Terms") set forth the conditions for using the iOS application "PicCue" (the "App") provided by Daisuke Nakagawa (the "Developer"). By downloading or using the App, you are deemed to have agreed to these Terms.

Article 1 (Scope)

These Terms apply to all relationships between the Developer and users regarding the use of the App.

Article 2 (License)

The Developer grants you a non-exclusive, non-transferable right to use the App for personal, non-commercial purposes.

Article 3 (Paid Plans)

  1. Certain features of the App are available through the purchase of a paid plan ("PicCue Pro").
  2. Purchases and payments are processed through Apple's App Store and are subject to Apple's terms and conditions.
  3. Monthly and Annual Plans (auto-renewable subscriptions)
    • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
    • You can cancel via iOS Settings → Apple Account → Subscriptions. Deleting the App does not cancel your subscription.
    • After cancellation, paid features remain available until the end of the period already paid for. No prorated refunds are provided.
  4. Lifetime Plan (one-time purchase)
    • "Lifetime" in the Lifetime Plan does not mean the lifetime of the user; it means that the plan remains valid for as long as the Developer continues to provide the App.
    • If the Developer discontinues the App, or if the App ceases to function due to changes in Apple's platform specifications or similar circumstances, use of the Lifetime Plan may end accordingly.
  5. After a paid plan is canceled or expires, new use of paid features (such as registering reminders beyond the free limit or creating/editing recurring reminders) will be restricted. Your already-registered reminder data will not be deleted.

Article 4 (Disclaimer Regarding Notifications)

  1. The App's reminder notifications use iOS local notifications. Notifications may not be displayed in the following cases:
    • When you have not granted notification permission, or when notifications are restricted by device settings (Do Not Disturb, Focus modes, Low Power Mode, etc.)
    • Due to iOS specifications and limitations (such as the limit on the number of simultaneously scheduled notifications)
    • When the device is powered off, or due to other causes not attributable to the Developer
  2. The Developer assumes no responsibility for any damage arising from failed or delayed notifications. We recommend that you do not rely solely on the App for managing critical appointments.

Article 5 (Data)

  1. Data registered in the App (images, reminder information, etc.) is stored only on your device.
  2. If you uninstall the App, your registered data will be deleted and cannot be recovered.
  3. The App does not currently provide a data transfer feature for device migration.

Article 6 (Prohibited Conduct)

  1. Reverse engineering, decompiling, or disassembling the App
  2. Copying, modifying, redistributing, or reselling the App
  3. Any conduct that violates laws or public order and morals
  4. Any other conduct the Developer deems inappropriate

Article 7 (Changes, Suspension, and Termination of the Service)

  1. The Developer may change the content of the App or suspend or terminate its provision without prior notice to users.
  2. The Developer assumes no responsibility for any damage incurred by users as a result.

Article 8 (Disclaimer)

  1. The Developer does not warrant that the App is free from defects, whether factual or legal (including with respect to safety, reliability, accuracy, completeness, and fitness for a particular purpose).
  2. The Developer is not liable for any damage incurred by users through the use of the App, except in cases of willful misconduct or gross negligence by the Developer.
  3. Even where the Developer is liable for damages, the amount of compensation shall not exceed the total amount you paid in connection with the App during the past 12 months.

Article 9 (Changes to These Terms)

The Developer may amend these Terms when deemed necessary. The amended Terms take effect when posted on this page. Material changes will be announced in the App or on this page.

Article 10 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Developer's place of residence.
